Afterhours AI is built from the ground up with real estate compliance at its core. Our AI voice agents operate within strict legal and regulatory guardrails to protect you, your brokerage, and your callers. Below is a complete summary of the laws, rules, and standards our platform complies with.

Federal Law

Fair Housing Act (42 U.S.C. § 3601–3619)

The AI includes hardcoded guardrails that prevent it from ever mentioning, referencing, or commenting on protected classes — including race, color, ethnicity, national origin, religion, sex, disability, and familial status. The AI will never discuss school quality or ratings, crime statistics, neighborhood demographics, or make any statement that could constitute steering.

When callers ask about these topics, the AI uses natural deflection responses that redirect the conversation without referencing Fair Housing law. These guardrails cannot be overridden by agent configuration or custom scripts.

TCPA (47 U.S.C. § 227)

The AI captures verbal consent before any follow-up contact. When collecting a callback number or email, the AI confirms: “Is it okay if [agent name] reaches out to you at this number?” Consent is timestamped and logged. The AI never makes outbound prospecting calls or sends unsolicited texts.

Georgia State Law

Georgia Real Estate License Law (O.C.G.A. § 43-40-1 et seq.)

The AI operates strictly within the boundaries of an unlicensed assistant as defined by Georgia law. It shares factual listing data authorized by the licensed agent but never performs activities that require a real estate license.

GREC Rule 520-1-.07 (Unlicensed Assistant Rules)

This is the cornerstone rule governing what our AI can and cannot do. The AI only shares listing information that the agent has explicitly authorized in writing through their Afterhours dashboard settings. The AI never discusses “attributes, amenities, terms, or conditions” of real estate beyond reading factual data from the listing. It never provides advice, recommendations, or suggestions regarding the sale, purchase, or leasing of real estate.

What the AI shares (with agent authorization):

  • List price, bedrooms, bathrooms, square footage
  • Year built, lot size, property type, HOA fees
  • Days on market, listing status, MLS number
  • Open house dates and showing availability
  • Property address and listing description as written

What the AI never provides:

  • Property value opinions or pricing guidance
  • Comparative market analysis
  • Negotiation advice or offer strategy
  • Property condition assessments
  • Investment or rental yield analysis
  • Title, financing, or closing details
  • Commission structures or agent compensation
  • Seller motivation or competing offer information

GREC Rule 520-1-.09 (Advertising Rules)

All listing data shared by the AI comes from authorized MLS sources or public data. The AI never embellishes, rounds, or adds qualitative adjectives (“beautiful,” “stunning,” “charming”) to listing data. It reads facts exactly as they appear in the listing.

BRRETA (O.C.G.A. § 10-6A-1 et seq.)

The Brokerage Relationships in Real Estate Transactions Act governs agency relationships in Georgia. The AI never creates implied buyer or seller agency relationships. When handling calls about listings from the same brokerage, the AI provides neutral, factual information without advocating for either party.

Georgia Fair Housing Act (O.C.G.A. § 8-3-200 et seq.)

State-level protections that mirror and extend federal Fair Housing law. The same AI guardrails apply.

Georgia Stigmatized Property (O.C.G.A. § 44-1-16)

The AI never discloses deaths, crimes, or other stigmatizing events that occurred on or near a property.

Georgia Wiretapping (O.C.G.A. § 16-11-66)

Georgia is a one-party consent state. Despite this, the AI proactively discloses call recording in every greeting: “This call may be recorded for quality purposes.”

Industry Standards

NAR/GAR Code of Ethics

The AI is designed to uphold the duties outlined in the REALTOR Code of Ethics by never providing pricing opinions, negotiation advice, or investment guidance that could compromise the agent's ethical obligations.

MLS Rules (FMLS/GAMLS)

Listing data is sourced from authorized data feeds. The AI never screen-scrapes listing data or shares information from unauthorized sources. Data display follows MLS participation rules.

AI Disclosure

If a caller directly asks whether they are speaking with a real person or an AI, the voice agent immediately and honestly identifies itself as an AI assistant. The AI never claims to be a licensed real estate agent, broker, or human. It never uses language like “as your agent” or “in my professional opinion.”

  • Listing Authorization Settings — agents control exactly which listing data fields the AI can share, satisfying GREC's “written authorization” requirement
  • Fair Housing Guard — pattern detection identifies caller questions about protected topics and triggers compliant deflection responses
  • Compliance Event Logging — every Fair Housing deflection, listing data disclosure, and TCPA consent event is timestamped and stored for audit
  • Full Call Recording & Transcription — every call is recorded and transcribed for review
